    Default Eviction in Colorado

    My question involves a roommate in the State of: Colorado

    I am renting a room from a person who owns a house in Colorado. She lives here also. I did not sign a lease.

    She has asked me to leave by October 31st due to the fact that I accidentally broke a lock on a window when opening it and that I also accidentally got some hair dye on the shower curtain in my bathroom. She says she thinks if I continue to stay here that the value of her home will continue to decrease.

    She has not gotten a formal court order, however.

    She also has $170 I gave her for a portion of November's rent and says she will give it back if there are no further damages when I move out.

    I did not pay a deposit when I moved in.

    I want my $170 back BEFORE I move out and if she refuses what should I do? Does she have to get a court order to evict me?

    If you want, you can force her to evict you through the courts. Expect that, if she gave you proper notice to vacate, you'll end up paying rent, court costs, and possibly attorney fees and, if she asks for it, an award for the value of any compensable damages the court found you to have caused.
