    Post Emancipation

    My question involves emancipation laws for the State of: Ohio

    I recently moved out of my mothers house, and moved in with a friend and her family. I did this because my mothers boyfriend is abusive and now has an open children services case for me and my siblings because of this. Well Ive lived with my friend for about three weeks now her and her family are okay with this they look at me as another child. I got a job and I am in my senior year of high school. But my mother is spreading lies and trying to get me in trouble with the law and my father who lives in another state. He found out about this and said I had three choices to either move in with him go back to her house or get emancipated. So to stay with my job, school and friends I need to stay in Ohio. So my question is that Is there any way I can get emancipated and stay here or not?

    Ohio has no statute for emancipation so your options are down to two

    Ohio will emancipate a minor in two, and only two, situations. One is if the minor is legally married; the other is if the minor is a member of the active armed forces.

    For both of which, you need parental permission and in some parts of Ohio, permission of the court.

    If the marriage or the membership in the military ends while you are still a minor, the emancipation is automatically revoked and you revert to being under the care and control of your parents.

    Sounds like you'd better decide which parent you want to live with. You do not have the legal right to remain where you are if your parents say no.

    You don't get to shop for an emancipation opportunity.

    Especially to live in another state.

    And Georgia has recently tightened up its emancipation requirements. RESIDENTS of Georgia have about 1 chance in 10,000 of being emancipated. A non-resident would be wasting time and paper by applying.

    Actually, I look into that every so often.

    I cannot find a single record of an emancipation in Georgia since 2005... when they tightened up the regs.

    Like most state governments, Georgia's websites are, um, convoluted.

    Therefore, I call.

    The Georgia Department of Health and Human Services, Office of Program Planning and Policy.

    And then I call the Independent Living Program, because they are the ones tasked with monitoring the children that have BEEN emancipated or are living alone.

    According to the very nice lady on the phone when I called this morning, in her 20 years, there haven't been more than a handful... she said 2... emancipations in Georgia that didn't take advantage of the pregnant teen loophole that was closed in 2005.

    And both of those happened PRIOR to 2005.

    I am still looking for the statistics on line to show you... but they may not exist.
