My question involves criminal law for the state of California... my brother received a letter from KNOTTS BERRY FARM accusing him of stealing a toy gun. He is 21. He did not steal it, it was a $6 toy. They had put him in a security office when it happened, saying he stole it, but he had bought it earlier that day. There is no evidence! No proof! But the letter is from a law office telling him to pay $400 or they will file a civil suit against him..
What happens if he refuses to pay, there's no evidence, will they file?
What if they do file and he loses? Will we have to spend $$ to prove him innocent?
And if there's no evidence can they charge him criminally?
