    Default Time Limit for Name Change of Babies?- TX

    My question involves name change laws in the State of: Texas

    I had tried to get a protective order against my ex for my son and myself, but he never opened the door to take the papers, so I never got it served. He is not sane, and does not believe he has a problem, therefore will not get help.

    I am seeking help for that part of my problem, but I am wondering if there is a time limit on changing a last name of a baby? Or under these circumstances, if it will be easy to do? He is not going to give me the authority to do this, if he has a say in it. I don't want him in our lives, he is not healthy. He needs help which he won't get. I don't trust him, and I'm scared of him. I don't want my son to carry his name. Can I do this? Or how if he won't allow it?

    Changing the child's name is not going to keep him out of the child's life. If he is not willing to agree to it, it will not be an easy task.

    Is he legally the father of the child? If so, you will not be able to keep him out of the child's life, unless you can prove, with evidence, that he is a danger to the child. Otherwise, if he goes to court for any type of custody or visitation, he will be in the child's life.

    If he agrees to the change it will be easy.
    If he doesn't agree, you can take the issue to court, but you'll have to prove in court that the change is in your child's best interests.
