    Default DWLS Identifying Wrong State as Issuer of Driver's License

    My question involves criminal law for the state of: TN

    I got convicted of 1st DUI in TN.. Never had a TN license but I have a MI license which is suspended because of something else.

    Got pulled over 2 weeks after i was convicted of DUI.. Did not have valid license.. Cop writes me a ticket for Driving on a suspended TN license..(too lazy to check computer, automatically thought it was suspended because of DUI)

    I checked with DMV.. Somehow I fell through the cracks.. MY license is not suspended in TN nor do I have one here. They told me they have no info of anything by going by my name and birthdate and SSN as if my DUI never happan.

    So doesnt that mean my DWLS should get dropped since the officer screwed up? He wrote me a ticket for DWLS on a TN license and its not suspended.. Never stated anything about MI license on ticket..

    Right now Im trying to get the DMV to write me a paper saying they have no record of suspension or anything..


    Yes it was suppose to be suspended for the DUI but I guess I got lucky..

    if its suspended in michigan, its suspended everywhere. if you tried to get a license in another state, they contact the BMV from the state you are transferring from. If you have no license and try to apply for one in a different state, it will come up in the computer and you will be denied. It didnt used to be that way but im 95% sure that all states converted to a national system. i remember my mom telling me it was happening a few years ago, clerk of courts, but ill look up if it ever came to be

    Well I talked to a layer just now.. He said the case is grounds for dismissal. the Cop wrote on the ticket DWLS on a TN license, not Michigan..

    Lawyer said DA could refile proper charges but probably will not since the cop creditability is at stake since he made a mistake of writing down the right charge he could had mistakan which car was drving without their headlights..

    Personally I think the COP was HIGH, but thats just my opinion.

    The cop wrote on the ticket that I was currently suspended in TN for DUI. I am not suspended in TN according to DMV... Looks like the cop saw on the computer that I had a DUI here and assumed it was suspended.
