    Default Open Intoxicants

    My question involves criminal law for the state of: Michigan

    I am a student at the University of Michigan majoring in Mechanical Engineering and 21 years of age. I was arrested for open intoxicants while walking back to my friends house. My question has to do with pleading guilty or not guilty. I have never been arrested before so this is my first get together with the police from Ann Arbor, MI.
    I have to appear in court in 2 weeks and wanted some advice on how to proceed-The police told me that this would be on my record for 6 months and taken off after that period of time. They also told me I might have to take a alcohol awareness class or something to that nature.

    Back in the house, from where? Were you on the sidewalk, in the street walking on public property to or from the house with this open container?

    In the first post i misspoke and said that i was arrested. I was only issued a citation stating i had a misdemeanor for open intoxicants( this might qualify as technically getting arrested...i have no idea). I left the party that i was at to go see a friend that lived probably 50 yards away. It was later at night and they had decided to go to bed. So I proceeded to walk back to my friends party. With literally about 10 feet left until the lawn of my friends house, a squad car pulled up. They grabbed the beer (in a red solo cup) and threw it in the road. After showing them my id, they then issued the ticket and i was on my way.

    Ok. so they saw you on public property and they got you on public property. At this point I would plea not guilty and attempt to get a court ordered public defender at no extra cost to you. you have a better chance of getting it reduced. personally i just wouldnt shell out the cash for a lawyer for a charge like this. however, there may be a real lawyer on here that can give you good guidance in this issue. possibly contact a lawyer your family knows or a friend knows and get some advice? i wish i could help you more, but anything i say wouldnt be of any legal guidence to you, just what i would do personally.
