    Default Right of way between two properties owned by the same person

    I own one acre and a half on a road which has my house, a barn, and a garage on it. I also own 15 1/2 acres of land 1/4 of a mile behind that, with a legal right of way between them spelled out in my deed/title with exact surveying terms. My question is, can the farmer that owns the land between my parcel disrupt/cultivate/plow this right of way?

    Default Interference with Right of Way

    Ordinarily, if you have a right of way reflected in the servient estate's title history (i.e., the other farmer's title history), and the right of way has not been extinguished under state law, the farmer would not have the right to interfere with your use of the right of way. You would likely benefit from discussing this with a local real estate lawyer, who can review all of the relevant facts and title documents so as to determine everybody's present legal rights and your legal remedies.
