    Default Demand for Civil Restitution from King Soopers

    My question involves criminal law for the state of: Colorado

    If you are given a Demand for Cival Restitution for shop lifting a $7.00 item from King Soopers and you pay the $250 penalty does it go on your record? The security guard stated it was not a criminal issue if the cival penalty is paid within 10 days. Does anyone know if it will be found in a background search?

    I believe you got that answer in your other thread. However without criminal charges being filed you will not have a criminal record

    Panther10758, thank you for such a quick reply. This is the only thread I posted, unless I accidentally posted twice. I did ask another poster if they had been charged.

    After reviewing both again, I am correct in thinking that the store does not necessarily send it to the police for charges unless the civil demand is not paid?

    My questions may be redundant but I am a licensed professional in Colorado and this could ruin my career.

    Paying Civil Demand does not guarantee no criminal charges will be filed nor does not paying do so

    I'll say it

    If the civil demand is paid it is unlikely that there will be
    a criminal case pursued

    Thanks for your input PJ.

    I went back to King Soopers yesterday and spoke with the LP person who caught me. He stated that if I paid the civil demand it would not go any further. If I do not pay, they will pursue both criminal and civil cases.

    Of course I will pay.

    I suppose most people find this site after the fact, as did I. Making one bad decision can negatively affect your family’s whole life. I did not go into the store with the intention to steal. I had just gotten contacts earlier that day. While doing my weekly shopping trip I had to use some re-wetting drops. I opened the package at the pharmacy and threw the box in my cart with the intent to pay for it with everything else. At check out, the clerk rang up my $250 worth of groceries and did not pull out the empty box. She gave me the total...the bagger saw the empty box, and asked if it was mine. At that split second, I made a horrible decision and said "no". After leaving the store LP informed me that eye drops were one of the most common items stolen and that they watch people via camera who are in that department.

    I am a professional who makes a decent six-figure salary. Stealing a $6 item was not out of necessity. At that split second at the check out I had to make a choice. I made a horrible one! If convicted, I would lose my license to practice my profession. That stupid mistake could have cost me my career.

    It was also very embarrassing to have to go speak with LP again and even more embarrassing to have to tell my wife what I had done. I will absolutely never steal again!!!

    i was charged of not paying 7 dollers to kings supper for an item( i thought i payed it) and king supper security guards caught me at door and they took me inside the room and they searced my bag everything and they found the item the one of security person went out and billed the item and came they where about to call the police i pleaded them that i would never repeat it again but they didnt listened finally they didnt call police but they gave me demand for civil restitution paper in that i was asked to pay 250 dollers
    my question would be there any criminal charges even if i pay the fees would that effect my status as i am non residents of usa as they have taken my pi cuter in cam and item which i took.please help as i am having sleep less nights
