My question involves criminal law for the state of: Michigan
On 9-11-08 My home was invaded by the local narcotics team. They were informed that we had drugs growing on our property. They found 1 female plant and a male plant that was pulled several days earlier. He had a search warrant and insisted for me to show him where everything was. I did show him where we kept our paraphernalia and about 4 joints worth of pot. He stated that was not what he wanted he wanted the crop and or bags we were selling. Which we had neither pot for sale nor any selling tools. The officer in charge told us that he would be back in a week to get us to roll on people to help us out but never returned.
Almost 1 month later 2 men from a fugitive team came to our home and took us in on the warrant issued 4 days earlier. They never read us our rights but cuffed both me and my wife and took us to the county jail. When we got to the jail my wife was frisked by a male guard as was I and we sat until we were able to post our $1500 bonds. The charges we received were both manufacturing/Delivery and possession.
Today we hired a lawyer and plead not guilty, our lawyer told us about the 7411 sentence and I have been looking for what this would involve and if it is available to us. My wife has no history at all however I have past felony convictions from 1989 and before.
My questions are what are the chances for my wife to get at most the 7411 and what are my chances. I have heard that our county is very lenient but have never been involved with this court. Also FYI I have never had any drug convictions and have carried a CDL class a for several years and have never pissed dirty. I am trying to get a job working for the same county road commission and am trying to keep my license.
