My question involves medical malpractice in the state of: TX & CO

I have been under the care of an orthodontic practice in TX and had my braces taken off in June. When i moved to Colorado I went ot a regular dentist to have a routine cleaning and to get a referral for a new Ortho to continue with my retainer checks. when i wentto my cleaning appointment i was blown away. I have never had a Cavity a day in my life. I now have 15. well under normal circumstances this could happen to anyone. But as the dentist was inspecting each tooth she noticed that on several teeth the Cement that holds the brackets in place on the braces was still in place and when my braces were taken off the orthodontist ground the enamel off my teeth instead of the cement. this inturn is what has caused my cavities. and on top of all of that the retainers that were made are not holding my teeth in place properly so i am getting gaps where there should be none. so now i have to pay more to have have the cavities repaired and the new orthodontist to close the gaps and make a new retainer.
my question is: do i have a case of malpractice for the enamel being removed and leaving the cement?
