My question involves emancipation laws for the State of: South Dakota.
I am 16 years old and I have had alot of family problems and disfunctions for years and I am getting tired of it. I am a good kid, proud of my Heritage and Culture, I do not drink or smoke or do any drugs, i am not perfect, but i need your help and advice. My mother is an alcoholic and my father had stopped talking to me a few years back, my step dad is controlling to the family and has a temper, in fact my mother just might be leaving him. The reason why i want to be emancipated is because i just cant handle the stress of having to be worried in my house, i dont want to contact Child Services or anything like that because i dont want my brother and sister to be taken away, just me. If i can follow through with this process then when i am 18 i will try my hardest to get custody of my brother who suffers physical abuse from my mother. There is fighting and arguing [B]every single day[B] in this house and stress when my mother drinks, and she drinks often, quite often, about any time we have money. When she drinks my step dad will be at work and i will have to take care of the kids and take care of her. When i try to go to bed when shes drinking i will stay up with her up untill 3:00am some days, and she will come into my bedroom and bother me and keep me up and argue. My step dad i feel has looked at me inappropriately and in fact once when my mom had been drinking she had confronted him with it, she talked to him about it the next day and he told her "well maybe she should put more clothes on" and I DO, i wear clothes just like any other person. And he should not be doing that in the first place, he is an ex cop so i dont know why my family is like this, its getting in the way with my grades in school and i need answers and advice so please help me. I need to know if i have a "good enough" reason to be emancipated, if i am old enough, and what are the processes here in South Dakota. So far i know you need a job to show the court you can support yourself, somewhere to live, and you need to go to school.

I could stay with my boyfriends parents, but i know that that would be inapropriate, so i would stay with his grandmother and in my Lakota way she is Unciwaye (my grandmother), i would stay with other relatives but i do not talk to them or are close to them and they are out of state.

also i know you need your parents signatures, since i do not talk to my biological father that much,but he does know what happens at my house, could he sign the release fourms?
