    Default I need to be emancipated

    i am tried of living with my mother she treats me like no child should be treated. We live in something that a dog shouldn't live in. I need to get out. She abuses me and shows favortism towards my older siblings who are of age, and i can't live like this anymore.

    My solution is i found someone to become my roomate that is of age and employeed. I am employeed to and in the summer i will be working full time. i think i cold support myself. I already supply all my needs and even pay rent to my mother. My mother has no job, no source of income but the state. I need to leave before someone gets hurt and i am betting it won't be me.

    Default Michigan Emancipation Law

    To be emancipated in Michigan, absent a circumstance which automatically results in emancipation (such as marriage or active duty service in the armed forces), you would have to convince a court you are able to support yourself, and are capable of managing your financial and social affairs. Michigan's emancipation statutes are available online.

    The situation is less important that weather or not you can support yourself, it seems you can support yourself, I believe the law states that you must have your own name on the lease of an appartment though.

    STATUS OF MINORS AND CHILD SUPPORT (EXCERPT)
    Act 293 of 1968


    722.4a Petition; filing; signature; verification; contents; affidavit; service on parents or guardian; notice of hearing.

    Sec. 4a.

    (1) A minor seeking emancipation shall file a petition for emancipation in the family division of circuit court in the county where the minor resides. The petition shall be signed and verified by the minor, and shall include all of the following information:

    (a) The minor's full name and birth date, and the county and state where the minor was born.

    (b) A certified copy of the minor's birth certificate.

    (c) The name and last known address of the minor's parents, guardian, or custodian.

    (d) The minor's present address, and length of residency at that address.

    (e) A declaration by the minor indicating that he or she has demonstrated the ability to manage his or her financial affairs. The minor may include any information he or she considers necessary to support the declaration.

    (f) A declaration by the minor indicating that he or she has the ability to manage his or her personal and social affairs. The minor may include in this section any information he or she considers necessary to support the declaration.

    (2) The petition shall include an affidavit by any of the following individuals declaring that the individual has personal knowledge of the minor's circumstances and believes that under those circumstances emancipation is in the best interests of the minor:

    (a) Physician.

    (b) Nurse.

    (c) Member of the clergy.

    (d) Psychologist.

    (e) Family therapist.

    (f) Certified social worker.

    (g) Social worker.

    (h) Social work technician.

    (i) School administrator.

    (j) School counselor.

    (k) Teacher.

    (l) Law enforcement officer.

    (m) Duly regulated child care provider.

    (3) A copy of the petition and a summons to appear at the hearing shall be served on the minor's parents or guardian. A notice of hearing shall be sent to the individual who provided the affidavit required under subsection (2).

    your right it doesn't say you have to have your name on the place you live you just need an address, I've read in other places that you need to have an appartment yourself so I got confused. Personaly I think a letter from a phycologyst would be very convincing, if it's real.

    If I had a nickel for every teen who thought they should be emancipated i would be rich! Listen if life is that bad or abusive then report abuse to Socail Service or Police. They will remove you from home and with another family member or safe place. They will also investigate complaint and if need be file charges. In many ways I think we should let the "know it all" teens live are their own so they can see what real world is about! However in nearly every post on this subject I see teen has someone else to live with that will support them thats NOT what emancipation is about!!

    Emancipation is about supporting yourself, it's like if your 18 and move out but it's harder... I want people to know that i'm NOT one of those whining babys who wants to be emancipated, the reason I'm on this site is because law interests me, I want to be a lawyer and I find life is easier when you know the law, so if I don't know a law, I find it. I don't know everyones situation and I don't care, Emancipation is about telling a judge, hey, I can support myself and thats what I want to do, also I am mature enough to know what that means. My personal situation is nobodys buisness, but I am having problems at home and looking into the legality of emancipation, BECAUSE MY FRIEND SUGGESTED IT and I had heard about it but didn't know the truth. I am talking to my friends, and trusted adults about my thoughts on this subject and if I were to pursue it, it would be after much thought, I don't want to be bunched with the "whiney teens" because I copy paste a law so that someone can read it.
