My question involves search and seizure law in the province of: nova scotia, canada
my two friends and I were sitting on a ledge talking and our bikes were by our feet on the side walk, a cop comes by and tells my friend to move his bike, my friend moves it from laying on the side walk to upright leaning on the ledge
the cop then says he is going to seize the bike because it is obstructing the sidewalk, so now all of our bikes are upright leaning against the wall and the cops bike is sideways directly blocking the side walk my friend and the cop tug on the bike because my friend says ''you cant just take my bike, what about there bikes. there on the sidewalk too.''
i ask the cop under what grounds is he seizing his bike on, he does not answer, i say this is stupid your not taking his bike for nothing and i grab it from him and take it to my house. i come back and my friend is in the cop car with handcuffs on.
that all happend on july 29 of this year i get a letter on the 20th of this mouth saying i am going to be charged with obstructing a police officer, is it worth fighting in court, saying he tried to take the bike for no reason and that he was just harrasing us?
