    Question Statute of Limitations

    My question involves collection proceedings in the State of: Georgia


    I have been recieving phone calls and letters every couple of months this year from a company(third party) trying to collect a debt from 1997. I had an account with the company in 1993 that was paid in full. I have asked for a copy of the contract that from the third party company showing that I had an account in 1997 with the company that they are trying to collect the debt for. I have yet to recieve it, but I still keep getting the phone calls and letters for collection. Some advice to me was to get them to stop callling just threatin the third part company with the Statue of Limitations. The company had been known to take old accounts and open new accounts with the old info. I didnt have an account in 1997 with them, can I use the Statue of Limit law to get them to stop harassing me?

    The Statute of Limitations only means that you have an affirmative defense if they sue you. Since this is supposedly from more than 10 years ago, send them a letter telling them you are not going to pay. Once you do that, the FDCPA states that they must cease communication with you. They cannot legally report this to your credit file, so you should be in the clear.
