    Default live in nc alienation of affection possible?

    We have been married 10 yrs, my mother in law and brother in law have been telling my wife to leave me for 8 of them. I pled guilty to involuntary manslaughter in may 2005 due truck accident i was involved in. now am attending college to get back on our feet after discussing it with my wife. She has decided in past month to move out and end our marriage. Her brother sent money for her to get apartment, can I file alienation of affection against mother in law and brother in law who live in VA?

    also believe someone else may be involved with my wife, but can't prove it yet. what are my options if someone is? (in north carolina) :cry:

    Default Alienation of Affection

    Well, alienation of affection is usually brought against an outside love interest... but I don't think North Carolina's law requires that. So I guess it's theoretically possible. You may have difficulty convincing a lawyer to take the case on anything but a retained basis, given the facts you outline.

    If somebody becomes involved with your wife after you break up, that's not "alienation of affection" as you are already estranged from each other.

    I understand about after, but if someone is envolved now and that turns out to be the reason she is leaving, that opens them up for a criminal conversation/ alienation lawsuit doesn't it?

    The mother-in-law and brother-in-law where always thought they where sneaky about it, trying to call when there spouses where not home and trying to imply they would leave in that situation.

    (Supposedly my mother in law has been unhappily married for 40 yrs now.)
