Question Second Shoplifting Offense - Can I Avoid Jail Time?

My question involves criminal law for the state of: GEORGIA

I am in my 30's & was charged 4 yrs ago with misdemeanor shoplifting to which I was able to do a diversion program.

Unfortunately, I was also charged with felony shoplifting this past week for a 2nd incident.

I'm not on here to make excuses, I didn't make a mistake ...I made a wrong choice & I know I have to pay the consequences. I'm a college-educated, suburban mother who no one would ever guess has any problems with the law. I obviously have a problem that I'm looking to get into therapy for...the shoplifting is just a manifestation of a larger problem. I intend on hiring an attorney but my biggest concern is how to avoid jail time. I currently stay at home with young children & it would be devastating to my family.

Thanks for any help you would be able to provide!

Yes, specifically, is jail time common with a 2nd offense & is it avoidable? How much do lawyers usually charge to defend a case like this? So far I've been quoted $3500...is that a pretty normal fee? Again, this is in GA.

A lot of things factor into sentencing, including the conviction charge. You may, for example, be able to plea bargain this down to a misdemeanor. If the court believes you're mentally ill and are getting treatment, that may influence the sentence as well. (But that implicitly involves telling the court that you've been getting away with a lot of shoplifting, so be careful how you approach that.)

The best way to find out what lawyers in your community charge to defend people against felony shoplifting charges is to call them and ask.
