My question involves a roommate in the State of: New York
I rent a small two bedroom apartment in Manhattan of which I share with one male roommate who moved in this past August. My name is on the lease as are all the bills, electric, cable and internet, of which I pay. My roommate pays only his half of the rent.
Last week my ex wife informed that her company has transfered her to their London office for one year. We both have joint custody of our 14 year old son. My ex and I believe that it is in our son's best interest that he should stay here in Manhattan where he is attending school and should move in with me.
I gave my roommate a letter informing him about the situation and that he needs to move out. The problem is that he is refusing to leave and has threatened legal action against me and has become unpleasant and at times even menacing. When he moved in he and I signed a standard ‘roommate agreement’ that specified that we give one another at least a 30 day notice, I have given him a 42 day notice.
My question is, does he have a case and should I just ignore his threats. And what if anything I can do to have him comply with my request and how should I deal with his behavior.
