I recently acted as a private agent in the estate sale of a $40,000 Jaguar automobile. An oral agreement with the deceased-owners daughter provided that anything over $37,500 would be my fee as acting agent. I took care of all the DMV paperwork and sold the car within 10 days of advertising to a financially qualified out of state buyer, and we finalized the transaction here at my home with everyone walking away happy as can be, the daughter telling me she would send my commission check the following day. Two days later I received a $500 final statement check from the daughter and a thank you note. Unbelievable!
I'm in the process of sending an invoice for services rendered with an acknowlegement of the $500 partial payment received and a request to pay balance within 30 days. If I don't receive any communication from them (no one responds to my calls), I'll take it to small claims court.
My question... do I stand a chance of recovering my money based
on an oral agreement?
