My question involves a child custody case from the State of: michigan
Well here I go again. My ex's boyfriend punched me when I approached him after an exchange with our son. I just wanted to know who he was. Maybe I shouldn't have but my ex and I both agreed until our son is old enough to talk and let us know what is going we would tell each other when someone new came into his life which I had but she never did so I wanted to see what was going on. He filed charges saying I assaulted him when actually he punched me so hard I was in the hospital emergency room that evening. So now the courts revoked my personal bond on the false assault charges my ex had filed against me from back in July and I am to wear a tether for both charges until this is all done and over with. I can't go within 1/4 mile of either of them. My ex told the courts that I am stalking her (which I am not). I don't want anything to do with them. So here is my question.....Our court orders say that the mother is to pick up the child at the beginning of her parenting time and the father is to pick up the child at the beginning of his parenting time. There is nothing in there about a third party pick up either way. My lawyer told the judge this was a child custody issue and that my parents are willing to pickup our son and she agreed but nothing was written. So tonight my mother and a friend are going to pick up our son but I am afraid my ex will not give him to them. Can she do this legally? If she does can I file contempt charges?
