    Default Touched by My Teacher in California

    My question involves criminal law for the state of: California

    My 40 year old teacher invited me over to his house and touched my breasts when I was 17, he also took his clothes off in front of me and made me take my clothes off. There was no consent. He told me never to tell anyone. I'm 21 now and want to tell someone. Was there a crime committed and can I still press charges?

    What do you mean by he "made me"??


    Regardless of age, if he "forced" you to do this, it is criminal, yes. This would greatly appear to be a FELONY.

    Report it to the police and they will investigate it. It all depends on what "specific" crime was committed that will determine if a timely charge can be filed within the statute of limitations.

    I'm not sure how to describe what happened. He took my shirt off and touched me. I didn't take my own shirt off. He was sitting next to me on his couch. I hit him afterward but I don't think I struggled while he was doing it. I think I held my arms against my shirt but he got it over my head anyway. It was really confusing, I'd never experienced anything sexual with anyone before that. Before he touched me, he took his clothes off in front of me. He was saying things about me that made me feel bad and said he would stop saying them if I took my clothes off. I'm sorry I'm having trouble being more specific, I haven't talked about it much until now.

    I understand your confusion.

    Carl who posts on this forum is a CA police officer, maybe he will have some thoughts on it if he reads it.

    The age of consent for intercourse appears to be 18, however I do not know the age of consent for sexual contact without sifting through CA law, such as the touching of an erogenous zone.

    Also the fact he is an "authority" figure, as your Teacher, may also play into this. Some states forbid such contact regardless of the consensual age of the student.

    Yes, Carl will probably have the citation of California law handy to post, but every state law I've looked up on this issue makes specific provisions about teachers and their students in the public high school system.

    All sexual contact is prohibited with any student over whom they have control, even if you were otherwise capable of giving legal consent.

    There are going to be some specifics that would need to be addressed including details of the event. I have about a dozen questions I would ask off the bat if you were to come in to my office, but I hesitate to ask them here for the sake of propriety (a few of them can be graphic).

    There are a number of possible statutes that might apply here - again, depending on the details. Suffice it to say that it is very likely that charges can still be made.

    Contact the law enforcement agency that had jurisdiction where this occurred, and contact them immediately. Depending on the details, the SOL may soon pass (if not already) on one or more of the offenses.

    Is there an SOL in Ca on felonies? I don't have the penal law in front of me about the S'sOL there. Sorry.

    For my part of the world, there is no SOL on any such felony. Of course, that presumes under Ca law that this is indeed a felony. Since I don't know details, I don't know what level of crime has been committed.

    OP, if you're too confused here talking to anonymous people under an assumed named about what happened, you're going to need to really think about that day before you talk to the cops, at least if you want top charges on this. The devil's in the details.

    Ambiguity in your statements makes it hard for charges to stick.

    Also, it might be a good idea to seek the help of a professional to help you with how you feel about this. Remember, it isn't your fault he's a d-bag.

    Just be prepared for some tough questions. Unfortunately, that's often why women don't want to file charges. My thoughts are with you.

    Yes there are. Many felony sex crimes can be ten years from the age of majority (so, 28 years old), however - on its face - this act appears to be a misdemeanor, and depending on the answers to specific questions, the SOL may have been only one year from the time of the act.

    Sex crimes can have a patchwork of SOL depending on the specific offense(s).

    For my part of the world, there is no SOL on any such felony.
    Just like here, WA has a patchwork as well (RCW 9A.04.080).

    Ambiguity in your statements makes it hard for charges to stick.
    The police will be asking some very specific and personal questions ... you will not be able to be shy about what happened. You might also consider accessing counseling or victim services when you speak to the police.
