    Default How Do I Report a Fraud Marriage?

    I have a good friend who's been dating this guy for about 2 years. she broke up with this guy 3 months ago. but they went to vegas and got married this january. now since she was already married and he was on a student visa, she felt bad and now she wants to go through with the whole interview procedure. I don't think it's right and I think the guy is trying his best to get the green card from her. she is the nicest person in ther world and she would be willing to help other people out with what ever she can. but I think doing this is wrong and his playing her. he is telling my friend that he can't get his student visa also so he will be illegal if she doesn't go to the interview. is this true? and is there anything he could do to get his student status back? i really don't like this and would like to report it... and if i do, will she get any kind of fine or possilbe jail time? what can i do to help her?

    YOU have no standing, legal or otherwise, in this matter. If HE wants to pursue this, that's his option.

    Just to make clear, they got married when they were still in a "good" relationship, right?

    Then, later they split up. So as long as they got married with the correct intention, not soley for the purpose of getting his green card, you friend did not do anything illegal.

    She can still go to the interview process, but she must be honest. She must say that the relationship did not work out. That is the best she can do to help him, and still be legal.

    The process they are going through it to adjust his status from a student VISA to a Legal permanant resident. If that is denied, as long as there is no fraud involved, he will still be elgible for the student VISA. He must comply with those requirements of course.

    They question you pretty good in the interview, and also look for lots of evidence of their life together, so it would be very unwise to try and lie in the interview. It would be highly likely they would be found out, and yes then she would be subject to criminal charges of marriage fraud.

    so if she doesn't go to the interview, can he still apply for his student visa again so that he is not illegal in the states right away? and if they are not together can they still say they are at the interview? is that lega? and what would be the consequence of lying at the interview?

    If he's married to a citizen, why's he going after a student visa at all? He's outright eligible for citizenship provided he follows all the right guidelines.

    If your friend knowingly went into this marriage with the specific intent of it being a fraud to get him into the country, then said friend can likely be prosecuted for it.

    Said friend can try to have the marriage annulled if they haven't consummated it, or file for divorce.

    You can file a report about it stating why you believe it's a fraudulent marriage, but if they investigate and determine it was done to defraud the government, your friend might well face prosecution.

    well... the guy is telling her that he can't get his student visa if they get an anullment. so he's giving her guilt trip for her to go through with this. that is the only reason she is going to the interview. but if he could still stay here and get the student visa... i don't think she'll go through with this whole process. and the fact that she is going to lie at the interview saying she is still with him. so isn't that illegal? and they only got married for the green card purpose for him. not because fell in love.

    Why are you all up in her personal life? If you think a law has been broken, you're free to contact the relevant authorities. Short of that, there's nothing you can do.

    Your friend is an adult. If she chose to break a law, she can either continue to break it and others (lying to an official), or she can break it clean now and either luck out, or do her time.

    If she wants to know what to do, she may contact an attorney. If she wants to let this manipulate her, then she gets all that's coming to her.
