    Default Renewing Permanent Resident Visa With A Felony

    Hi-

    I was convicted of a felony at age 18 (I'm now 21), and I need to renew my Permanent Resident Visa in 2007. The felony charge has since then been reduced to a mesdimeanor, and the judge promised to expunge it when my probation ends june of the present year. How will this affect me?

    Will I ever be able to apply for a United States Citizenship? I know that any sentence of moral turpitude punishable for 1 or more years is negated for citizenshipt. However, does having a reduction and expungement help me at all?

    (The Felony was a 245(a) which is an assault w/ deadly weapon in the state of California. As you may know, it is a crime of moral turpitude)

    Default Weapons Charge and Immigration

    The actual sentence is irrelevant - the USCIS looks at the maximum sentence. And they may well look at the original charge, and the full facts and circumstances of the charge, when making any decision relating to your immigration status. You should consult an immigration lawyer.

    The max sentence was 5 years.

    The assault with deadly weapon had no injuries at all. The court bascially forced me to take the deal, but that's another story.

    Will the fact that it is a midemeanor now play anything into the decision?
