My question involves criminal law for the state of: Alabama
I have a warrant, possibly warrants, for a misdemeanor probation violation, (didn't actually do anything but leave the country), however, it seems that's enough to issue a warrant. And it may be one of the "bench" variety, possibly even as an FTA, and I don't actually know if I can come home or not. I am unsure what is checked about one's status as they re-enter the US, whether by air travel or land, and was wondering if anyone knew with any degree of certainty what the case is. I know that you can be extradited for felonies from state to state, but what about misdemeanor probation violation warrants, and would an FTA or bench warrant on a misdemeanor have any change on extradition laws. If I know for sure, and for some reason I absolutely have to come home, I'd prefer to save myself the time and agony of chained transport via extradition across the country and I could just fly home and keep the trip short. But if I can re-enter without immediate arrest at the point of entry, I may be able to make my way home and potentially resolve the issue with the judge once I'm back. The degree of leverage lost once incarcerated is something I am, unfortunately, familiar with. Negotiating details from behind bars is next to impossible!
My question is obviously on a few levels, but more directly, does anyone know, specifically, what things are checked when a US citizen re-enters at any point of entry into the US?
