    Default Moving to Canada and Taking Our Son

    My question involves a child custody case from the State of: Oregon

    I live in Oregon and I married a Canadian citizen here in the states. We have one child together (2 years old) and we both currently live in Oregon.

    When angry he always threatens me the possibility of him moving back to Canada and taking our son with him. I'm worried he might flee during his parenting time with our son and I was wondering if there was something I can do to stop him?

    If he does cross the border I'm worried I'll never see my son again! Please help!

    You can divorce him in Oregon, and seek an Oregon custody order. You can do that, if you wish, the moment he takes off. The cross-border issues can complicate things, but generally speaking Canada will respect a U.S. court's jurisdiction over a divorce and custody case where the parents and child were living as a family in the U.S. up to the point of the filing for divorce.
