    Default Problem neighbors

    I have been renting a duplex in hopes of buying from the elderly owners. Two years ago a middle aged couple moved in upstairs and things seemed fine.
    Long story short:The husband became ill and then the problems started. The first noise complaint was filed by the next door neighbor, in a seperate building due to a bedridden man screaming for help at 1:30am while his stepdaughter was in the next room. The second noise complaint was filed by me due to a loud party, a wake as I found out later when the gentelmen passed away, but a late, loud, boisterous party regardless. No one informed me and no one attempted to contact me or I probably would not have complained. Other issues have occured and I've attempted to speak to the tenants on various occasions without success.
    The structure has separate laundry/storage and garage space and I keep my space locked to prevent the upstairs tenants from using my laundry (which they have in the past) I recently discovered some items missing from my storage space which would have only been accessible while I was home. I spoke to the stepdaughter and informed her that I didn't think she or her mother took the items but very apparently someone that they had allowed into the building did. The items only total around $150.00 so insurance fraud is not the reason, my renters insurance has a $500.00 deductible.
    I filed a complaint with the police and informed my landlord that if timely action was not forthcoming, he should consider this my notice and that I would be leaving per the lease agreement.
    Can the landlord evict the tenants based on these complaints? I understand that I have to provide 90 days notice, which I will abide by should it come to that. Lastly my lease was yearly, signed in 2000, is this now considered month to month, even if the lease says year to year renewal?

    The bedridden, dying old man died. His wake is over. The landlord probably has few concerns that a noise problem will continue. You have no evidence that the other tenant is in any way responsible for any theft. So I wouldn't count on the landlord deciding to evict a paying tenant.

    If your lease states that it renews on an annual basis, that's normally what occurs.

    That assumes that this isn't prohibited by state statute. But, the other lease terms normally apply even after the lease expires, unless state statute provides otherwise.

    Which is why I qualified my comment; but I don't know of any state which prohibits such a clause. Do you?
