    Default Felony Probation Alcohol Violation

    I was convicted of a 3rd degree felony for Theft to Auto in the state of illinois and put on 2 year probation. I am 20 years old now but i was 18 when convicted. I was transferred to TX to go to school and thus was also transferred for probation. I have 4 months left of probation with no violations and all restitution paid off. I went in to probation this morning and blew a .017 at the breathalizer. What can happen to me????? My probation officer said she needed to send the information to Illinois and then she will see what they say....can I go to jail for such a minor violation, or what? my crime has NO connection to alcohol or anything, and I have no previous history. will they tell me i can't attend school in TX anymore?

    One of the standard conditions of probation is that you have continued law-abiding behavior. So, yes, they can revoke your probation and put you in jail for the remainder of your sentence.

    How did it not cross your mind that drinking the night before a scheduled hearing with your PO might be a bad idea? Now you risk losing out on this term's course work (and who knows how many more) for violating a drinking law.

    The best way to find out is to contact your old PO in Illinois and ask him what to expect.

    After your sentence is up (assuming they call you back and put you in jail), you're free to return to Texas for school. But the court in Illinois has total discretion as to whether it wants you to go back to jail or not.
