My question involves restraining orders in the State of: Delaware
Hello,
I have already read many threads here and understand that the judge must withdraw any order they issued. So I will just explain my situation and ask for any advice.
My boyfriend and I had a domestic incindent a few months ago. He was charged with offensive touching, criminal mischief, Under $1000 property damage and drunk on a highway. When the police arrived they informed me that if I wanted to press charges an order of protection would have to be issued. He was taken to jail, called me several times from the jail. I accepted one call to tell him I would not pick him up. He was released the following day and called me to ask if he could "come home". I told him I would take him to a detox center (something we had discussed prior to this incident) He completed the detox program and moved back in with me.
I did not contact the courts or the police because I wanted to see how things went and if he would change his behaviour. Also if there was another violent incindent I wanted the history to be present.
Unfortunatly, we have just learned that there is a warrant for his arrest for failing to appear to his arraignment. Because he was ordered not to live with me, we didn't get the notice. He plans to turn himself in tomorrow. And I was advised by the AG that I can just "magically be there too" and the judge may hear my side.
My question is what should I expect the consequences to be for me and for him? Will he go to jail? Have I commited a crime by taking him back?
Thanks in advance
