    Angry Theft by Deception

    My question involves criminal law for the state of: KY

    I work for at this store and back in july i went shopping and the cashier i went to check out to was underring/override my merchandised without my consent, i noticed and stopped her, she had and then continued to charging me for the right prices. i paid for my stuff and left. three weeks later i was at work when i got called back in the office by LP and store co-manager, they questioned me an i told exactly what happened, they asked me to write ii and i did and then i got fired and was told to paid back for whatever was underring and i did, it was $5.00 worth.

    I moved on got a job, but a week ago i got a summon to go court next week. i was shocked that i got charged with 'theft by deception' and what they were accusing me off were not how i explained on the "writing statement" and they also said i owe $7.00.

    So please what should i expect from all this? i am a student and want to get a job once i am done with my nursing, any help/advice would be appreciated.

    can somebody please give me some advice. i just talk with an attorney and i am debating whether to hire him or just go to the summon alone and then plead not guilty then hire him...is that wise?

    Interview your lawyer then decide which approach to take. That's not a decision we can make for you.

    Theft by deception in the amount of $7 would be a Class A misdemeanor. KRS 514.040. Ask your lawyer if you might be eligible for a diversion program or deferment, such that you might avoid a criminal conviction. If you want to fight the charge, be prepared to explain why you didn't instruct the cashier to properly charge you for all of your purchases, and why you didn't report the incident to your mutual employer.

    thank you. also i did tell her to stop the underringing when i noticed and she did stop. what i should have done is make her started all over again.

    I just want this off my record and don't want to go jail i just can't handle that.

    This is something to discuss with your attorney as part of your defense. You did tell her to stop. Did you also ask her to correct and deficiencies? Or did you knowingly allow all previous underrings to remain uncorrected? Or did you just not notice quick enough or something?

    I should have make her correct them once i saw what was happenning but i didn't. i am going to talk with the attorney and have him go with me instead of just wait till the court appointed me one and then have to to back. this is the biggest mistake i ever made in my life and it is haunting me, i can't sleep at night, my school works are suffering, i just want this over with(without going to jail) and go back to my normal life.
