    Default Talked Into a Vasectomy While Wife Was Planning a Divorce

    I am not even sure this is a valid suit, my wife and I where married for 2 years and had a child together. when the topic of birth control came up we talked about the pill, iud, and what not. how ever she thought a tubal would be good, she then hinted about a visectomy. So i got one so she would not have to go through the pain and danger of tubal. Now we are divorced, and she stated she knew she didnt want be with me before the visectomy.
    Is it possible for me to sue her for the cost of a reversal? on the grounds that she limited my dating potential? and the fact i am severly phobic of needles and what not.

    How does a vasectomy prevent you from dating?

    If you thought that you might have wanted to have a child at some point in the future, then you shouldn't have elected to have a surgery to prevent it. Just because you're married doesn't mean you can't use: the pill, a condom, depo, a diaghragm. There's a reason that vasectomies and tubal ligation aren't given out very easily. That consultation you had with the doctor wasn't a mere formality.

    I understand that , and i did not consider the consult a formality. My wife sat right there in the room with my and we both stated we did not want to have any more children together. How ever she had no intention of staying with me. It does not prevent me from dating just really limits who I can date. Now if i date anyone who may want to have kids in the future this potentially ends any chance of a relationship.

    And why is that? Why is it impossible to wait until you are in such a relationship, if you ever are, before you get a reversal? What's the matter with adoption? Why must you be capable of having kids before you can begin a relationship?

    Now, I don't date a lot these days and never with members of the opposite sex, so I'm not sure how it all goes . . .

    But when you're on a date, is it common for the do you want to have a kid conversation to come up that soon?

    I can see there being a potential issue after a long while of dating someone if she wants kids. But it would seem to me that in the meantime it would solve more problems than it creates.

    Have you yet tried a reverse vasectomy, or are you waiting to see if you wind up with someone who wants to have kids?

    I'm not really sure that you have an issue right now for which you can sue. I don't want to get into too much of your personal life with your then wife, but if you guys were doing the deed even a little after your operation, then it would seem to me, in my opinion, that she didn't act in bad faith.

    People say all kinds of vengeful, hurtful things during and after a divorce. Kinda goes with the territory.

    You can certainly obtain a reversal now if you - for whatever unfathomable reason - believe you'll never date again if you don't, but ultimately, your ex-wife is not responsible for it.

    You signed the consent forms, which usually include a clause about not signing under duress.

    They do, and my doctor even read it aloud for me, asking twice if I understood.
