My question involves criminal law for the state of: Pennsylvania
Let me start this off with I'm a really good kid, I do everything right, and don't do anything "bad". I have a 3.3 GPA in all college prep classes... but...
A year ago I was with a friend at a snowboarding mountain, and I took a pair of goggles.... and they had it on camera; they found us on the mountain and called the police. While the police were there, I was nervous as anything, and as freaking out as I was, I like to the police and said I didn't take them, and then they played the tape. The officer said "I was just going to let you off but because you lied to me like that, I'm charging you with theft by unlawful taking".
So lying doesn't work don't do it. I got it now.
I went to court like 4 months later for some reason, I don't know why so long. I went in and met with a public defender right before the case... she said I'd get probation and that's all... I ended up getting house arrest. Great.
30 days later, I was off, and one of the terms was 'don't get in any trouble in school'; we have a school based probation officer...Strike one.
I'm such a class clown, and over the next three months, I got over 15 detentions, only in school, I don't have any problems outside of school. And my probation officer violated me... I went back to court... Expecting to get something serious...The judge brought my lawyer to tears because he was yelling at me; he said "if I ever see you here again, I'm going to lock you up. GOT IT?!" And got house arrest for another 30 days... Strike two.
So now, I realize, finally, that I am digging myself into a huge hole that I'm going to be stuck in my whole life. I got all my shit together, and started acting right....For the next 7 months.
from March until September I had ABSOLUTELY nothing wrong I was a champ in school, and didn't give any teachers problem. I got most of my 100 hours of community service done... And met my PO for all my meetings, except one that I missed, and called him the morning of, he said it was fine. So my senior year starts, and I'm still doing fine... Until last Friday, and this all happened on the same day; most horrible day of my life.
I got a detention. For turning in two late notes a day late, because my dad was away on business....Then I get another referral for clowning around in the parking lot, and jumping on the hood of a friends car. All my previous detentions were giving teachers a hell of a hard time.
Then to top it all off, I go to tell my probation officer that I got them, when I told him he said it was fine, and just no more.... Then he said he hasn't drug tested me in a while, and he should now...
I don't know what I was thinking when I did this, I have a though process problem, and I never smoke (you can believe me or not), but two days before, I took a hit. One hit. I told him before I tested positive for THC.
When I did test positive, he said he'd have to talk to his supervisor, and see what will happen.... That Monday I went in and he said it'd be a probation violation. Strike three.
I'm scheduled to go into court next Tuesday, and I don't know.... I want some idea on what you guys on here think will happen, or what I can do to not get locked up....
