    Default Resigned and Ex-Boss is Lying

    My question involves labor and employment law for the state of: Indiana.
    I resigned from my job in April of this year because my boss put me in the middle of a lie with a Government Inspector. I filed for unemployment and he denied it saying I quit because of "personal reasons"....another lie. I appealed my case 3 times to no avail, but I am now happily employed else where so I just let it go. NOW...he is telling people where I worked and others in my community that he had to let me go because of work I had not done properly. Is that legal? I was under the impression that he could not discuss my employment or the lack of.

    FYI- I have my resignation letter and ALL the documentation about my resignation and the unemployment cases.

    Despite a persistant belief to the contrary, no law in any state prohibits a former employer from discussing your employment. The myth that says he is limited to dates of employment, salary and job title is just that - a myth.

    If at some point in future he says something that is provably untrue and you suffer provable damages as a direct result, you can at that time take legal action. But the law does not prohibit him from saying what is true, what he honestly believes is true, or what represents his honest and supportable opinion. Even if his opinion is negative.

    Indiana employers who disclose information about current or former employees are immune from civil liability unless it's proven by a preponderance of the evidence that the information was known to be false at the time of disclosure.
