    Default Apartment Wasn't Ready On Time

    Ok. So me and a couple of my friends were going to get an apartment together and so we find one! We pay a $650 "holding" fee and it is going to be transferred into a security deposite upon move in. Well we were insured that we could move in on the 15th of September but then it wasn't ready. I did not sign anything nor did any of my freinds. So we had to be out of our other place or our landlord was going to have the cops remove us and so I was forced to look for another place that would be avaliable sooner. Well we find one and go to talk to the landlord but instead talk to her husband who tells us that we CAN get the money back and to come back the following weekend. So we do and she tells us that we cannot have the money back because it is unfair to the lady they send the money to b/c they had had to refuse people who were intrested in it. Well they also have two other apartments and NONE of them are ready!! So what should I do!! Do you think this will hold up in court? I live in the state of Idaho!! Anyone that can help me out please do so! Thanks!!

    Take the landlord to small claims court. You were assured the unit would be ready by a specified date, it wasn't, the landlord breached your verbal agreement.

    It would be easier for you if you had actual paperwork, but verbal contracts are just as enforceable.
