    Post My Speedometer is Broken, Should I Fight the Speeding Ticket?

    My question involves a speeding ticket from the State of: California

    I was paced at 81 mph in a 65mph zone of the highway at about 8:30pm. The officer pulled me over and cited me with 22349(a)vc. The interesting thing is that I did not know I was speeding because my car was vandalized earlier that month. The vandal(s) broke my driver's window, stole my radio, slashed my seats, and sprayed black paint on my speedometer. Is there a way to dismiss or fight my speeding ticket?

    Having a "broken" (I say obscured) speedometer is no valid reason why a speed citation would be dismissed. If that was the case why can't someone just say, "I couldn't see how fast I was going because its unsafe to look away from the road, therefore I couldn't look at my speedometer to see how fast I was going". Working or not, you are still responsible for the velocity at which you drive your 4000lb + vehicle down any given road.

    If you are going to fight it then use the search function on the forum and see how to get the patrol car's speedometer calibration records. If their speedometer is not properly calibrated then you have a chance...or if the officer does not show...

    I am not sure I would use the "I don't know if I was speeding because my car wasn't legally allowed to be on the road" defense, but that is just me.
