    Default Double Felony Charges for Sale of a Controlled Substance

    My question involves criminal law for the state of: Florida

    My fiancee had broken his elbow and had needed surgery. As a result his job fired him and we were in need of money for groceries, gas and diapers for our children. He had been approached on the street while walking around looking for work about selling his pain pills (granted he was still in a partial cast and a sling). He had originally said no, but in despiration agreed. 5 weeks after that incident had transpired he answered the door and was arrested for that incident, since apperently the guy that he sold the pills to was an informant. He has never been in any kind of trouble before this and has no criminal record, yet is being held with a $28,000 bond and in a maximum security facility.

    1. Is entrapment a possiblility in this case?
    2. What are the time statutes for arresting for this type of crime?
    3. What are the possible scenarios for an outcome with this case?
    4. Why is he being detained for such a high bond with no criminal record?
    5. How long is a lawyer allowed to not get in touch with you? Cause he calls and the lawyer does not speak to him, nor give him a call back and it has been 3 weeks now.

    Due to this whole stuation we have lost our house, i have had to move back in with my family and he has no family to go live with even if he gets out any time soon and can't come live with me (dad does not like him). Because of all of this, this is exactly how I feel right now. Any help that anyone can give would be great.

    Anything is possible. However, the DEA regularly employs informants, who are often previously convicted drug dealers who agree to work with them, to sting people. Since the informant is not a sworn officer, it is unlikely that this would be deemed entrapment.

    Much longer than 5 weeks in any jurisdiction in the country.

    Hire an attorney to negotiate a guilty plea and no jail time, plead guilty and get the best deal you can with a public defender, plead not guilty and be convicted and sentenced to jail. Those are the three most likely things I can think of.

    4. Why is he being detained for such a high bond with no criminal record?
    He is being charged with trafficking, which is a serious felony.

    Does he have his own lawyer, or a public defender? If a public defender, he can expect slow responses in general until it gets closer to a hearing or trial date.

    From your description, he committed a felony. He is therefore guilty, and should be trying to work the best deal he can in exchange for his guilty plea. For that, he needs a good criminal attorney - one he has hired to handle this case for him.

    I am sorry you are having this problem. Being a DEA agent myself all I can tell you is that he is in major trouble.

    Was he arrested by the DEA? or by a local agency?


    The prison time for a federal charge is much longer then a state charge as there is NO parole in the federal system. No time off for being good in prison, etc.
