    Default Car Blew Up One Week After Purchasing; Was Sold As a Different Year Than What It Is

    My question involves a consumer law issue in the State of: KY


    I’m going to attempt to make a long story short. On 08/09/08 I purchased what I thought was a 2000 Pontiac Grand Am. From a buy here pay here lot; I paid 3000.00 down on the car and have since made one payment.

    One week later on 08/16/08 the car overheated and stopped running. I had to pay 300.00++ to have the car towed home. Naturally, only having the car one week, I called the dealership to let them know about this. They told me the car was sold as is and had no warranty but they would fix it at a “discounted rate.”

    At this point I’m really ticked off and was probably acting out of anger, but I reported the lot to the BBB. The BBB say nothing can be done as the car was bought as is, unless misrepresentation was a factor in the transaction. BBB carbon copied the dealership a copy of my complaint; I got a call from the upset owner of the dealership and he told me he’d have the car towed to his garage (at my expense!) and fix the car—he’s not charging me labor, only parts. That was 6 weeks ago. I’ve sit for 6 weeks without my vehicle.

    Well, I registered the car on my insurance policy and ran a car fax history report (should have done this before hand!!) Turns out the car is actually an 01 model. I understand that this is very petty, and may even work out to my advantage—but I have a receipt that clearly says the car was sold to me as an 00 model. This is clearly misrepresentation—am I entitled to my money back? What legal rights do I have here as a consumer? I can’t keep going without a vehicle. Every time I call about it they say it’s not fixed and they’re still waiting on a head gasket. I’m approaching my second car payment date and do not want to dish out anymore cash.

    Please help. I don’t know what to do.

    Were you informed of this prior to purchase?

    Turns out the car is actually an 01 model. I understand that this is very petty, and may even work out to my advantage—but I have a receipt that clearly says the car was sold to me as an 00 model.
    I don't think that getting a slightly newer car than you thought you were getting is going to have any bearing on things.

    I was never told whether there was or wasnt a warranty.. stupid I know. I should I have asked more questions but didnt b/c the guy was a mechanic that sold the car and I assumed it was a good deal.

    Read your contract and look for the warranty answers there. Often cars are sold as wrong years, especially since modelt changes don't happen as often as before. It is up to the buyer to confirm VIN's and build dates. This is clearly stated on the driver's door or door jamb on EVERY car, mandated by federal law.

    You can check if there is a lemon law for your state and if you qualify.

    For future knowledge, anytime you buy a car, new or used, always keep a very close eye on all fluids. Check daily to monitor any usage, loss, or leaks.
