    Default Granting Power of Attorney After a Diagnosis of Alzheimer's Disease

    My question involves estate planning in the state of: California

    If a person is recently diagnosed with mild to moderate Alzheimer's are they still able to sign a durable power or attorney? I was told that I should apply for a conservatorship which seems drastic at this point. Will it help if a doctor states that the person is capable of understanding what he/she is signing? What about a lasting power of attorney?

    We have no way of knowing this person's impairment. What do their doctors say about their competence?

    If in doubt, get a guardianship through a court.

    It all depends. To cover yourself take the person to an attorney or either have an attorney come to them. Get a statement from the doctor that they have capacity.
