Some states/municipalities have enacted laws to forbid smoking in a motor vehicle when a minor is present. Theory, there is no retreat, and the children have no choice but to breathe second hand smoke, unlike the home environment where there are many rooms and the outside to retreat too.
Are the minors essentially "captives" in the car?? The 1st AM, on a side note, recognizes the terminology "captive audience" where one is forced to listen, as they have no means of essential escape.
Are the children/minors a "captive audience" per se?
1. Are these laws Constitutional?? Yes? No?
2. Is it the government's business to tell you you can not smoke around a minor, your child or not? Yes? No?
I say yes to both counts.
I do not smoke, never have, but would NOT around children, irrespective of law or not.
