    Default Smoke Free Vehicles

    Some states/municipalities have enacted laws to forbid smoking in a motor vehicle when a minor is present. Theory, there is no retreat, and the children have no choice but to breathe second hand smoke, unlike the home environment where there are many rooms and the outside to retreat too.

    Are the minors essentially "captives" in the car?? The 1st AM, on a side note, recognizes the terminology "captive audience" where one is forced to listen, as they have no means of essential escape.

    Are the children/minors a "captive audience" per se?

    1. Are these laws Constitutional?? Yes? No?

    2. Is it the government's business to tell you you can not smoke around a minor, your child or not? Yes? No?


    I say yes to both counts.

    I do not smoke, never have, but would NOT around children, irrespective of law or not.

    Yes on both for me also. I am a smoker and have been for years but have never smoked in my car when my children, or any child for that matter, are in the vehicle. I also do not, have not, will not smoke in my home.

    Yowsah from me to! I'm a smoker also but my behavior has always been with responsibility and courtesy as the primary concern(s)......I've never "subjected" anyone to my second-hand. Simply put, it just ain't the right thing to do to someone, "captive" or not.

    Right on Dave. Passive smoke is a Class A carcinogen.

    At first when reading the title I thought you were talking about diesels. Mine smokes ALOT

    Like where?

    I'm a smoker, but my children, alas, don't know I smoke. Smoking in my home is a big no-no. Smoking when the kids are at home, or awake is also a no-no.

    Hell, my last boyfriend didn't even know I smoked for almost a year. I just don't smoke around non-smokers. Hrm, does that make me deceptive? Or courteous?

    But yes, I would think that a law protecting a minor from a substance known to contribute greatly to a hastened death would be legal. Say, like it's illegal to give them smokes. That should be a law. Oh, it is!
