My question involves child support in the State of: MI/AR
My parents moved to Arkansas 23 years ago, dads ex wife moved here 22 years ago.
Ex wife had child support case transferred from Michigan to Arkansas.
Michigan on numerous times in the past claimed dad was behind on support and took their tax refunds.
In 1995 dad obtained letter from child support in Arkansas stating he had in fact paid all of his support to his ex wife for the kids and had a zero balance.
Youngest child is now 32 years old, and yesterday dad got a letter from Michigan child support again saying he owes 43,000 in back support. They claim he never paid support at all even though the case was in fact transferred to the state in which both parties resided and there is proof all payments were made.
Michigan is now going to garnish my fathers social security checks for this 43k. He just recently retired on medical and is receiving his ss benefits.
What can they do, dad is not in the health to travel to Michigan and cannot afford an attorney. He has congestive heart failure along with a couple other serious health issues. He paid his support as he was supposed to.
Is there a statute of limitations on child support orders, is there a way to stop them from taking this money from him that he does not in fact owe.
