    Default Expired Green Card and the Visa Waiver Program

    Hello,

    My husband got his green card, but never renewed it because we ended up moving back to his country. Now we want to go back to the US to visit family for two weeks (we have no intention on staying). He's worried that he won't be allowed back into the country since we just let the visa expire as opposed to telling INS that he was leaving. Will this be a problem for us when he tries to enter the country?

    It could be, if the agent you deal with decides to play tinpot dictator.

    Usually, though, abandoning your green card does not pose a problem when coming back to visit later.
