My question involves collection proceedings in the State of: Illinois
This forum is so informative--thanks to everybody who takes time to answer questions!
I saw a chiropractor in Illinois 2 years ago. All services were covered by insurance--both me and biller at chiropractor's office made sure of that by calling insurance at the time of 1st appointment. I have not received any communication from chiropractor for 2 years, then a week ago got a bill for $900. Today I've also received an explanation of benefits from insurance stating that claim has been rejected because chiropractor did not file it within the claim filing period (dates of service were in 11/2006 and they are submiting it now, in 09/2008!) Insurance is refusing to pay it now because of above reson. When I've called chiropractors office, they stated that they've been filing my claim ever since 11/2006 and insurance kept loosing it/giving them mixed messages. They've stated they have not contacted me in 2 years because they did not want to bother me and have been trying to resolve the issue on their own (???!!!) They are now demanding immediate payment.
I am not sure how to procede. What is considered "proof of timely filing"? Can I request it from chiropractor? If they do submit my bill to a collection agency, do I have a good case arguing that it was failure in their billing efforts?
