----Can my wife of 5 months be deported for a crime committed nearly ten years ago?------
My wife at the age of 20 in 1996 committed a felony involving credit card fraud while working at a department store. She admitted guilt and repaid the 18k she was accused of stealing while she was employed at the said department store. Last year (2007) my fiance (now wife) applied for US citizenship. And today we received a letter from Homeland Security stating that she has a pending deportation hearing, because f an ammended law stating that a crime was committed within 5 years of her then granted resident alien status. If she and i have been dating for over 6 years and recently married can they still deport her? If she was tried for and convicted, BUT repaid her debt can they still deport her? And is there anything i can file to fight her deportation since i am a Legal US citizen? I am seeking leagal counsel but i wanted a non biased opinion. Thank you
