Default Bank Has Been Holding Third Party Check for Three Years

My question involves a banking matter in the State of: NJ

I deposited a third party check for $48,000 in my bank account. Initially the bank released the funds and I spent about $15,000. Then when I went to close the account they noticed that it was a third party check and placed a hold on the remaining funds.

The bank's loss managment department told me the funds could be held for up to three years. Now it's three years later and they are still giving me a hard time. No criminal or civil complaints have been made. Can they hold my money like this? What can I do?
