    Exclamation Running Out of Options

    My question involves criminal law for the state of: Georgia

    My boyfriend was violated on drug charges back in October 07. He had npo other technical violations. (The judge took the remainder of his probation 6 yrs 9 mos)..the charges were dropped (no billed) in Feb 08...so now he is in prison for probation violation on charges that were droppped. So thus far we have filed paperwork with the judge that proceded over his hearing and he denied reinstating his probation. We've tried getting the dropped charges paperwork to the Parole board and the department of corrections 3 months ago and haven't heard anything from them(when we call to check on his case they just tell us that his case is under investigation)...he's filed a habeus corpus but lawyers wanted at least $7,500 to represent him, we don't have that type of money..so now what else can we do? We don't feel that he should remain in there for charges he doesn't have. We don't understand while they are still holding him in custody in an over crowded prison system (he's sleeping in a big tent outside the actual prison walls). Please anyone with ideas.......

    You clearly don't understand what is happening in his case. It's possible that he had a conditional discharge and, by violating his probation, cost himself the benefit of a dismissal. But his charge quite obviously was not dismissed.

    If he cannot afford a lawyer, he can seek a court-appointed lawyer for his probation violation hearing. But it sounds like the hearing has already come and gone.
