    Default Employer Stated That I Voluntarily Left

    My question involves unemployment benefits for the state of: IL.
    I was laid off this year and received unemployment benefits. I have worked for several temp agencys during this time because i receive unemployment I am unable to turn down any offers of work. I took an assignment from an agency and my car broke down. I informed them that I was having car issues and was told that unfortunately I would have to be replaced.

    I went to reopen my claim and received a letter stating that I voluntarily resigned and that I would have a hearing date. I was simply unable to get to that location because no transportation went there.

    Before I knew of any issues with my claim I took a part time job and I am continously looking for full time employment I still qualify for my benefits.

    What are my chances of getting my benefits reinstated???

    We cant determine your "chances" that is up to State once they hear both sides of arguement

    I understand that it is up to the state board. But considering that I did not tell the employer that I was leaving and was told I would be replaced. How can they tell such an outright lie? Especially considering the fact that they have not found me anything else and wont return any of my calls.

    Strictly speaking, it's not a lie. You were given an assignment; you did not report for work. The fact that you had a valid reason for not doing so does not change the fact that you are the one who opted not to go. I can see your point of view but I can see theirs too. It's not as cut and dried as you are making it.

    Maybe its not cut and dry. The agency told me their obligation is to their client. So its possible we both are at fault. Trust me if i could have made I would have went to the job. There is no public transportation that would have taken me to that location. I never missed days before this was an unfortunate event. In a perfect world I would have had the money to put my car in the shop and back on the road the next day. The agency told me that they would be more than happy to place me somewhere else because they only hear positive things about me guess thats why they arent returning any of my calls.

    Now i have to deal with this and this isnt an unpleasant situation especially with the way the economy is. Hopefully sticking to the facts will have a positive outcome in the end.

    The real question is my argument valid? Considering that I did not voluntarily leave and was informed by the employer that I would be replaced.

    We can say yes but that doesn tmatter. It what the state thanks and what your former employer says. We cannot predict your outcome as you desire.
