Question Roommate's Cat Wrecks Apartment - What Can I Do?

My question involves a roommate in the State of: New York

My roommate and I share a 2 bedroom apt in Poughkeepsie NY. Recently, things have soured between the two of us. Luckily, he stays to his room for the most part (and sometimes is in the kitchen) but that's it. The rest of the place is basically mine, with one exception - his cat. He refuses to leave the cat in his room, and quite often does not clean the litter box until days after it starts to really smell. Litter box is located in the pantry off the kitchen. As per our Month-to-Month Lease, he is allowed to have a pet. He is also close friends with our Landlord.

My problem is this - the cat is vicious - it will bite me from time to time - usually on my foot when I'm sitting in my arm chair in the living room (although there is rarely any marks left) - The cat also makes its home on my arm chair and couch, and stays off his Futon, thus creating huge piles of hair on MY furniture. I have spoken with him about this, and he claims that because he doesn't use his half of the apt - that gives his cat free range - as far as the stench from the litter box - he explains that cat piss smells - and its part of life - I should purchase an air freshener.

What can I do? Can I get some sort of order of protection from the cat? Is this legit? I mean the thing terrorizes me by biting my feet when I least expect it. Can I have the couch and arm chair cleaned professionally and charge him with the bill as it's mostly cat hair on the furniture? What can I have done to fix this problem?

Some history - He was originally willing to get rid of the cat when we 1st moved in together because of my allergies - once I realized that the cat really didn't set me off, I told him it was ok to keep the cat.

At this point, I'm not looking to make him get rid of the cat, but at the very least - keep it in his room (along with the litter box) - He never had an issue with cleaning it on time while we were still friendly to one another.

I'm at a loss - I think there's a good chance that he might move out soon, but nothing is set in stone - Please let me know what choices I have.

    Thank you.

You chose your roommate. You told him it was okay to keep the cat. This is the consequence of those choices.

Your other option of course is to move.
