    Default Job Forcing Unpaid Extra Hours

    My question involves employment and labor law for the state of: Washington.

    I work for a retail furniture company in Washington State, and I work commission sales. Recently our boss told all of the employees (including me) that we can no longer do paperwork regarding past sales or inform customers that their furniture has arrived during our scheduled work hours. Instead, we were told we have to come in early to work or on our free time on days off to do this. Is it legal for them to force us to do this?

    Also, we have two days off every week. We were also told by our boss that if we call in to work the day before the 2 days off, or the day after these said days, we have to bring in a doctors note. I thought you had to be off work for 3 business days before you had to do this, am I incorrect?

    For regular employees - those paid an hourly rate - it is illegal to require that they work "off the clock".

    I believe the rules are a little different for those paid straight commission, however.


    I thought you had to be off work for 3 business days before you had to do this, am I incorrect?
    There's no such law. An employer can require a doctor's note for any absence in which you claim illness.

    Man, that really sucks.. it seems like they shouldn't be able to make me do that. I just don't understand the logic that I can't do my paperwork during my normal work hours when I'm working commission. It seems like I'm being forced to come in extra hours for no reason.

    Does it matter also that the only way to do this paperwork is at the store itself? We don't get an option to take anything home with us either.
