    Default Fired After Day 1

    My question involves labor and employment law for the state of: PENNSYLVANIA

    I started a great new job, paying a wage I can actually live off, on 09/16/2008. I was fired @ 9am 09/17/2008. I was told exactly why I was fired. They told me I was fired because I had violent charges on my background check. I was arrested 01/12/2008 for aggrivated assault against 2 police officers. Whether or not the charges are true...-not-...is it fair for them to fire me on the assumption that im am guilty...better yet, Is it legal for them to fire me because of the charges? What steps can I take to get my job back or even file a case against the corporation. I did sign an agreement to be an "at-will employee" but they still hired me a full week after I gave them all my information for a background check....I just feel like..

    Did you not disclose the charges when you applied?

    I'd spend all my time and money getting the charges resolved. I know attorneys are expensive but not working is pretty expensive too. You can get a job in the trades (roofing, insulation, tree trimming) while getting this matter resolved.

    you state you were arrested. Were you convicted?

    What did you answer when you saw the question "Have you ever been convicted or arrested for a felony?" on the application?

    Did you read *exactly* how the criminal history question was worded on the application and answer truthfully?

    From what I gathered from his other post they are stringing him along he has not gone to trial yet. So they terminated him because he has charges pending not because of a conviction.

    As an aside from the Q's Betty and Jeff asked, the signing of an application that outlines your at will status has no bearing on such, it is simply a reaffirmation and notice of state law.

    Even if the application contained NO mention of it, and I have seen some that do not, is inmaterial. It is simply a notice to the employee and is not required by law they be told they are "at will".
