    Default Laid Off While Under a Doctors Care

    My question involves workers compensation law for the state of: North Carolina
    I have had an on going comp claim for carpal tunnel. The surgery has been done on my right hand with the left hand scheduled for surgery in about 2 weeks. I was laid off from my job along with 40 other people. In NC in order to draw unemployment one of the requirements is that you are physically able to work. I was then and still am under a doctors care with limits on the use of my hands (light duty). Since I am not allowed by law to sign up for unemployment is the comp insurance required to pay me?

    As long as you continue to meet the definition of disability (per w/c) you will continue to receive w/c. Benefits do not end because you are terminated/laid off.
