    Question Is It Legal to Keep a Child from His Father?

    My question involves a child custody case from the State of: OREGON


    My question involves my fiance' and the mother of his first child. I am the mother of his second child.

    Ever since we have been dating seriously, for about 2 years now, she will not let my fiance' see his son. She has forbid him from seeing his son as long as he has a girlfriend, even though he pays child support regularly and has never had any crazy issues, such as drug use or abuse of any kind. She will not even talk to him on the phone, or let him talk to his son. Recently she has not only changed her phone number, but has also moved and she has not let him know about any of these changes or where they are.

    Is it legal to move and/or change your number w/out telling the child support paying non-custodial parent of your child?

    I have known my fiance' for over 12 years and have good faith in the fact that he would do just about anything (within reason and law) to see his first son. He is on the birth certificate, and has had a chance to build a foundation of a good relationship with his first son from the time he was born until he was 3. Now its been 2 years!! Cant this hurt the child?

    Unless there is a court order that specifies otherwise - she is under no obligation to allow visitation.

    Has paternity been legally established?

    Does he pay child support through the courts, or in an informal way?

    He needs to petition the court to establish paternity, (if not already legally established) set child support, (if it hasn't been already) and very specific visitation guidelines, which spell out the ramifications to her and to him if one of them does not follow the guidelines.
