    Unhappy Arrested but Let Go (No Ticket or Charge), Probation Violation?

    My question involves criminal law for the state of: Michigan

    I've been on probation for all most a year now for 2 mip's and have half a year left. I've finished all my community service and took a required alcohol class. So I've pretty much coasting up to the point, doing nothing wrong. Last night a friend came into town and I picked him up to go out to eat. After that we were driving around and he asked me to pull over and he took out some marijuana (which up to that point had no idea he had), I walked with him to a building site, and watched him smoke it. I being on probation didn't par take in such and at that point wanted to take him home because I didn't want to be driving with that in my car. So on my way to his house I end up getting pulled over and both of us arrested. Long story short is that my friend was charged with marijuana use and I was let go with no charge or ticket what so ever. The Officer said that I should still inform my probation officer of what happened, so I sent in a monthly mail in today telling her of the situation, and am freaking out right now about what might happen. Since I was just let go with nothing am I going to be hit with a violation, or is it up to my probation officer?

    When you were sentenced, I'm sure you were instructed not to possess or consume alcohol and/or illicit drugs, or associate with those who do. What occurred might quite possibly be a violation of your probation.

    Speak with your PO; be honest but expect the question "You stood there and watched him smoke it - WHY?"

    I just talked to my probation officer on the phone and she said that if I didn't get ticketed that there would be no problem. She was confused to why I was fingerprinted and had a mugshot taken of me if I wasn't charged. I gave her the officers phone number and e-mail and I'm just hoping everything works out. I wouldn't think that the officer would go back on what he said about letting me go, as he was very clear in doing so. I told her my friend got a ticket and I didn't so she said that was a good sign. What to you guys think?

    Then consider yourself lucky. Next time...well, hopefully there isn't one, but if it should happen again; run and don't look back! You may not be as fortunate.

    Final thought - find a new set of friends! The ones you currently associate with might just be your downfall. Probation is NOT something you want to dangle the proverbial carrot in front of if you get my drift.

    Know why they would take my fingerprint and mugshot if they weren't planning on charging me? Also I feel stupid talking to him outside while he smoked, I wrote that in my report and hope that honesty wins out there. Again she made it sound like if I didn't get charged for it, then I'll be fine. Still I'm going to worry about this until it is 100% taken care of, every possibility keeps flashing though my mind. This person isn't in my core group of friends and someone that I just randomly knew from High School. I hadn't seen him in a year and a half and don't plan on associating myself with him again.
